Terms of Service

1. Agreement to These Terms

These Terms of Service govern your use of goalmaxxing, including the mobile app, website, and related services. goalmaxxing is operated by Tsimafei Launik, a sole proprietor registered in Poland ("we", "us"). By creating an account, using guest mode, or otherwise using the service, you agree to these Terms.

2. Eligibility

You must be at least 16 years old to use goalmaxxing. By using the service, you confirm that you meet this requirement and can enter into a binding agreement under applicable law.

3. Accounts and Access

You may access goalmaxxing through account registration, including Apple Sign In where available, or through limited guest mode. You are responsible for the security of your account and for activity that occurs under it.

We may suspend or terminate access if we reasonably believe there is abuse, fraud, security risk, or violation of these Terms.

4. Nature of the Service

goalmaxxing provides AI-assisted goal execution features such as goal setup, generated tasks, milestones, motivation, learning prompts, and social momentum features. Outputs depend on your input and model inference, may be imperfect, and are provided for productivity support only.

The service is not medical, mental health, legal, financial, emergency, or other professional advice, and it should not be relied on as such.

5. Acceptable Use

You agree not to misuse the service, including by interfering with operations, attempting unauthorized access, scraping in violation of law, reverse engineering where prohibited, exploiting the service for abuse, or using it to facilitate unlawful, harmful, or deceptive conduct.

6. User Content and Inputs

You retain responsibility for the goals, tasks, notes, answers, or other content you submit. You represent that you have the right to provide that content and that it does not violate applicable law or the rights of others.

7. Social Features

If you enable social sharing, certain goal-related information — such as your handle, goal name, goal category, and streak — may become visible to other users within the app, and other users may send you in-app energy. You can stop participating in that social visibility by changing the relevant profile setting where available.

Handles and shared goal content must not be unlawful, hateful, sexually explicit, deceptive, or impersonate another person or brand. We may hide or remove shared content or handles, and restrict social features, where we reasonably believe these rules are violated.

8. Subscriptions and Payments

Parts of goalmaxxing require a paid subscription ("Pro"). Subscriptions are purchased through, and billed by, Apple via your App Store account — we do not collect or store your payment card details.

Auto-renewal: subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your App Store account settings; canceling stops future renewals but does not refund the current period.

Refunds: because billing is handled by Apple, refund requests are made to Apple under App Store rules. Nothing in this section limits refund or withdrawal rights you have under mandatory consumer law.

Changes: we may change subscription prices or what is included in free and paid tiers. Price changes apply to future billing periods and, where required, only after notice through the App Store or the app.

You can restore a previous purchase using the restore option in the app.

9. Intellectual Property

The service, including the software, design, branding, and non-user content, is owned by the goalmaxxing operator or licensors and is protected by applicable law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the service in accordance with these Terms.

10. Third-Party Services

The service may rely on third-party providers such as identity providers, cloud hosting, AI processing services, notification services, analytics, and app distribution platforms. Your use of third-party services may also be subject to their own terms and policies.

11. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and process personal data.

12. Disclaimer of Warranties

The service is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee uninterrupted operation, availability at all times, or that AI-generated outputs will be accurate, complete, or suitable for your goals.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business interruption arising from or related to the service.

Where liability cannot be excluded, it is limited to the greater of the amount you paid for the service in the 12 months before the claim or EUR 50.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, or affects statutory rights you have as a consumer under mandatory law in your country of residence.

14. Termination

You may stop using goalmaxxing at any time and may delete your account from within the app where that functionality is available. We may suspend or terminate access for violations of these Terms, legal requirements, or security reasons.

15. Changes to These Terms

We may update these Terms to reflect product, legal, or operational changes. Updated terms will be posted here with a revised effective date, and we will provide additional notice of material changes where required by law. Continued use of the service after changes take effect means you accept the updated Terms.

16. Governing Law

Unless mandatory local law provides otherwise, these Terms are governed by the laws of Poland, without regard to conflict-of-law rules.
